9javendor Store Credit Terms & Conditions

1. Introduction
   1.1. 9javendor store credit is issued by or on behalf of the 9javendor entity listed in Appendix 1 (“9javendor” or “we”) to customers of its online marketplace (“you”).

   1.2. By using 9javendor store credit, you agree to adhere to these Store Credit Terms and Conditions as well as the General Terms and Conditions of Use of the 9javendor marketplace, which apply to all purchases.

2. 9javendor Store Credit
   2.1. 9javendor store credit refers to the credit held on your account and may include:
   2.1.1. Refund Credit: This is store credit representing a refund for purchases made on the 9javendor marketplace, available for indefinite use until it is depleted or withdrawn.
   2.1.2. Reward Credit: This is store credit issued as (a) a top-up to your account or cashback from specific purchases as part of a promotion, subject to the relevant promotional terms, or (b) as a 9javendor gift card available in select countries, which may also be subject to additional terms.

   2.2. You can use your 9javendor store credit for products and services on the marketplace. When using store credit:
   2.2.1. Any applicable promotional offers will apply to the item price before deducting your store credit balance;
   2.2.2. Applicable taxes and delivery charges will be deducted from your store credit balance;
   2.2.3. For purchases exceeding your store credit value, you can pay the remaining balance using other payment methods;
   2.2.4. Any unused store credit balance will be available for future purchases, subject to any applicable expiration period.

   2.3. If you receive a refund for products or digital services paid for with store credit, the refund will be credited back to your account, maintaining its nature as either refund credit or reward credit.

3. Limitations on Use of 9javendor Store Credit
   3.1. Store credit can only be redeemed within the 9javendor marketplace.
   3.2. Other than as stated in these terms, 9javendor store credit may not be:
   3.2.1. Used for payments outside the 9javendor marketplace;
   3.2.2. Redeemed for more than its face value;
   3.2.3. Transferred to another account or individual; or
   3.2.4. Sold or exchanged for cash or other prepaid payment instruments.
4. Further Limitations for 9javendor Store Credit (Rewards Only)
   4.1. Rewards are subject to the promotional terms under which they were issued and may only be redeemed:
   4.1.1. For eligible goods and services, which may change at our discretion;
   4.1.2. Within the specified time of the promotion or, if unspecified, cashback will expire within three (3) months and top-ups within seven (7) days post-promotion without further notice.
   4.2. We reserve the right to cancel or withdraw rewards at our discretion, particularly if fraud is suspected.
5. Withdrawing 9javendor Store Credit
   5.1. You may request a cash refund in lieu of refund credit by contacting us as listed in Appendix 1 or following withdrawal instructions in your account. To safeguard against fraud, we may limit or delay withdrawals and may ask for additional verification.
   5.2. Reward credit is not eligible for withdrawal.
6. Protection Against Unauthorized Transactions
   6.1. You are responsible for safeguarding your store credit and account from unauthorized use. Regularly check your account and transaction statements. We will email you notifications for every transaction, and you should verify that each transaction is authorized.
   6.2. Contact us immediately if you suspect any unauthorized transaction or access to your account, or if your login information has been compromised. Provide us with all pertinent information and assist in our investigation.
   6.3. We may apply restrictions to your store credit to ensure the security of the marketplace or if mandated by a legal authority. Such actions may rely on confidential criteria essential for managing risks, including fraud prevention.
   6.4. We will not compensate you for unauthorized use of:
   6.4.1. Reward credit, as it is issued at our discretion and can be withdrawn if fraud occurs;
   6.4.2. Refund credit if you share your login details with someone unauthorized who then uses your account.
7. Due Diligence, Audit Rights, and Investigations
   7.1. We conduct anti-fraud and anti-money laundering checks and reserve the right to request information and documentation from you for:
   7.1.1. Verifying your identity;
   7.1.2. Assessing risks associated with your account;
   7.1.3. Ensuring compliance with these terms;
   7.1.4. Complying with court orders; or
   7.1.5. Adhering to laws and regulations.
   7.2. You agree to cooperate, including providing statements to the police or relevant authorities in cases of fraud or disputes.
8. Warranties
   8.1. You warrant that:
   8.1.1. You will use store credit solely for your transactions and not on behalf of another;
   8.1.2. You will not engage in fraudulent or illegal activities with the store credit;
   8.1.3. You are not on any sanctions or restricted parties list maintained by relevant governmental bodies or authorities; and
   8.1.4. You will not export or transmit any restricted technology or commodities to prohibited jurisdictions.
9. Limitations and Exclusions of Liability
   9.1. While we strive for uninterrupted availability of store credit, this cannot be guaranteed due to internet dynamics, and access may occasionally be restricted for maintenance or upgrades.
   9.2. We are not liable for:
   9.2.1. Losses from events beyond our control;
   9.2.2. Business-related losses including revenue losses or goodwill;
   9.2.3. Data loss or software corruption;
   9.2.4. Special or consequential losses; or
   9.2.5. Losses not caused by our breach.
   9.3. Nothing in these terms limits our liability for any matter that cannot be lawfully excluded.
10. Indemnification
    10.1. You agree to indemnify us against any losses, damages, or expenses incurred due to your breach of these terms or any relevant policies.
11. Term and Termination
    11.1. The agreement under these terms begins upon receiving store credit and continues until terminated as per this section.
    11.2. You can terminate the agreement at any time by closing your account through instructions in Appendix 1.
    11.3. We reserve the right to terminate or suspend your store credit for breaches of law or policies, at our discretion.
    11.4. Upon termination, we will:
    11.4.1. Cancel any outstanding reward credit and return refund credit to your specified account within the appropriate timeframe;
    11.4.2. Close your 9javendor account; and
    11.4.3. Maintain the provisions of these terms that are intended to survive termination.
12. Variation
    12.1. We reserve the right to modify these terms from time to time.
    12.2. Revised terms will be effective seven (7) days after notifying you by email or written notice.
    12.3. If you disagree with any changes, you may terminate this agreement by closing your Jumia account.
13. No Waiver
    13.1. No waiver of any terms shall waive any further breaches of that term or any other provisions.
14. Severability
    14.1. If any provision is found to be unlawful or unenforceable, the remaining provisions will remain effective.
    14.2. If part of a provision can be deleted to render it lawful and enforceable, that part will be deemed deleted.
15. Assignment
    15.1. You agree we may assign or transfer our rights and obligations under these terms.
    15.2. You may not assign your rights or obligations without our prior written consent.
16. Third-Party Rights
    16.1. This agreement is for the benefit of you and us and does not grant rights to any third party.
    16.2. Exercising rights under this agreement does not require third-party consent.
17. Law and Jurisdiction
    17.1. These terms are governed by the laws of the territory where the issuing 9javendor company is located, as outlined in Appendix 1.
    17.2. Disputes will fall under the exclusive jurisdiction of the courts in that territory.

    18.1. Contact us through the email listed in Appendix 1.
    18.2. We may provide communications regarding your account electronically through our website or your registered email. Such notifications will be deemed received and acknowledged by you.
